Case of Child Return Order from Korea to Hawaii

This case involved the collaboration of Simon and Austin, who worked together to help a foreign client (the father) obtain a court order from the Korean Family Court for the return of his child abducted by his Korean wife.

Initially, the client did not request a child return order; however, upon reviewing the case, Simon determined that having the child located overseas, rather than in Korea, would be more advantageous for the client’s divorce proceedings.

Consequently, Simon proactively represented the client and filed a petition with the Korean Family Court to return the child, who had been abducted to Korea by the Korean wife, back to Hawaii, where the father resided.

The opposing party argued that there were exceptional reasons to refuse the return of the child. However, Simon successfully argued that the child’s habitual residence was in Hawaii, that the child had indeed been abducted by the Korean wife, and that returning the child would not significantly impact the child’s well-being. The Korean Family Court accepted these arguments and ordered the return of the child to Hawaii.
