Avoiding Serious Legal Consequences: A Case of Road Rage in Busan

February 1, 2024

In this case, our foreign client faced criminal investigation and trial on charges of pushing a delivery motorcyclist after being threatened by his reckless driving while returning home after a birthday dinner in Busan.

The victim demanded a settlement amount exceeding 20 million KRW, which made reaching an agreement difficult. However, Simon strongly argued that the client was a first-time offender and that the motorcyclist was the one who initially violated traffic regulations.

As a result, the client was able to receive a suspended sentence instead of actual imprisonment.

It is worth noting that assaulting a driver is a serious crime in Korea, with a mandatory imprisonment sentence without the option of a fine. Therefore, regardless of how angry one might be, one should never assault a driver, whether driving or taking a short break during their trip.
