Minimizing Penalties to Avoid Deportation: A Case of Trespassing

This case involved a client who, unable to move on from his ex-girlfriend, went to her front door and subsequently faced investigation and trial for trespassing.

The client retained Pureum Law Office for his defense. Simon Lee focused on minimizing the sentence to prevent the client, who had lived in Korea for a long time, from facing deportation. This strategy was based on the client’s admission of guilt and sincere remorse.

In the first trial, the court imposed a fine of 3 million KRW.

However, since a fine of 3 million KRW or more could lead to deportation, Simon persuaded the client to appeal.

In the appellate court, Simon successfully reduced the fine by an additional 500,000 KRW. With this outcome, the client underwent an immigration review and ultimately received only a written warning, allowing him to continue residing in Korea. The case was thus concluded.
