This case involved a client who, while intoxicated, had an altercation with a police officer.
Although the client’s actions did not amount to obstruction of official duties, the client was investigated and prosecuted for not possessing a passport.
Not possessing a passport falls under the Immigration Control Act, which usually results in no punishment or only minor penalties.
However, in this instance, the client, unable to recall the events due to intoxication, was viewed unfavorably by the police officer, who then referred the case to the prosecutor’s office, seeking severe punishment.
Simon Lee, representing the client, apologized to the police officer on the client’s behalf and submitted a strong legal opinion to the prosecutor, requesting the lightest possible penalty.
As a result, the client received a fine of only 300,000 KRW. Following this, the client successfully passed the immigration review and continues to reside in Korea.
