Supreme Court Reversal: Pursuing Compensation in a Complex Fraud Case

This case marks another instance where Pureum Law Office successfully overturned an appellate court’s decision at the Supreme Court level.

The client’s mother had been a victim of fraud by the defendant and sought compensation for damages.

However, the defendant was insolvent. The client initially won a damages lawsuit against the defendant to obtain a title for enforcement. Through further investigation, Simon Lee discovered that the defendant held a claim worth about 1 billion KRW against a third-party debtor. The client hired Simon to pursue a lawsuit to seize this claim.

During the lawsuit, however, the notarized document that formed the basis of the 1 billion KRW claim was dismissed due to a conflicting agreement.

As a result, both the first and second trials were lost.

Unwilling to give up, Simon appealed to the Supreme Court, highlighting serious issues in the lower courts’ legal interpretation of the agreement.

The Supreme Court accepted Simon’s arguments in full, overturned the appellate court’s decision, and remanded the case back to the appellate court for retrial.

The appellate case is currently ongoing.
