International family disputes often raise a fundamental question before the merits are ever considered: which country’s courts have jurisdiction? In this case, we represented an American client after divorce proceedings were initiated in Korea, even though the parties’ marriage, family life, and related proceedings were already centered in the United States.
Rather than focusing only on the underlying divorce claims, we argued that the dispute lacked a sufficient connection to Korea and should not be decided by a Korean court. The court agreed, finding that the case should not proceed in Korea and dismissed both the original claim and the counterclaim for lack of international jurisdiction. By successfully challenging jurisdiction, we prevented our client from having to litigate the dispute in an inappropriate forum and ensured that the case would be addressed in the proper jurisdiction.
