Stopping an Overseas Lawsuit Before It Could Move Forward in Korea

When a party living overseas files a lawsuit in Korea, procedural strategy can be just as important as the merits of the case. In this matter, an overseas claimant sued our client, who was residing in Korea, over a property division dispute.

Rather than waiting for lengthy litigation, we applied for a court order requiring the foreign claimant to provide security for litigation costs. The court granted our application and ordered the claimant to deposit more than KRW 34 million or provide an equivalent guarantee before the case could proceed. Faced with this order, the opposing party ultimately abandoned the litigation instead of moving forward. By taking decisive action at an early stage, we helped our client avoid unnecessary litigation and protected our client’s interests from the outset.
